Sliding Down A Slippery Slope

The case of the month relates to a geotechnical issue.   An adjuster called us with a case where a slipping hillside brought a wall of muddy debris into the backyard of the downhill neighbor.   The uphill neighbor represented by our client had an in-ground swimming pool.   The accusation was that the pool owner was negligent in maintaining his pool, which had caused the slipping hillside.

We were asked to investigate the cause of a stand pipe connection failure in the fire protection and sprinkler system of a major high rise building, located in Los Angeles. The failure occurred at the penthouse level when a section of horizontal 6 inch diameter pipe pulled out of a "Gruvlok" coupling.   As you would imagine, an open 6 inch pipe puts out a lot of water.   Damage was extensive-was it caused by a faulty installation, a manufacturing defect, or some other cause?

Case of the Month: Sometimes The Devil Is In The Documents

Occasionally the best evidence isn’t what’s evident on the roadway or what is purported to be vehicle damage from a collision. In this low speed collision case the key to understanding what happened turned out to be little clues with big meanings that were buried in the various documents submitted with the case file.
 
This case was a garden-variety low speed impact involving the front bumper of the insured’s car and the rear bumper of the claimant’s vehicle.   The collision occurred in October of 2001 but it wasn’t until January of 2005 that Garrett Engineers, Inc. was called in to help. By that time both the insured and the claimant had attorneys and the case was at an impasse.

Vice President’s Message-Evaluating Stairway Falls:

Let’s face it, stairways are a common hazard, but one we reasonably accept as necessary to get from one elevation to another.  Still, many injuries occur from stairway falls.

Almost all serious stairway falls happen while the victim is descending the stairway; typically they report that they “slipped” on a step.   However, the actual cause of the fall is usually not a “slip”, but a “mis-step”, and mis-steps are often caused by irregular out-of-code rise and run dimensions of the as-built stairway.
