Case of the Month: Warehouse Water Leaks – From the Neighbor?


The claimant sued the insured for causing mud and water damage to the claimant’s warehouse.   Specifically, the damage was allegedly caused by the insured’s recent construction activities at the insured’s adjacent warehouse.   GEI was assigned to investigate both sites and determine the cause and approximate age of the water intrusion of the claimant’s site.

Case of the Month: The Toppling Back Yard Walls

The homeowner lived on a hillside.  The house was at street level and the backyard descended steeply down the slope for several dozen yards. The homeowner hired a contractor to build a retaining wall and then a timber deck extending from the rear of the house to the top of the retaining wall.  Several years later, the homeowner had a contractor put in additional retaining walls to effectively terrace the remaining back yard with decks and planting areas.  A year later an irrigation pipe broke and the water caused several of the walls and stairs to collapse.  Our client wished to know whether the walls failed first or whether the pipe failed first.

Case of the Month: The Rat Repairs

The insured owned a late model Mercedes-Benz S500. He noticed an intermittent dash warning light and took it to the dealer for an estimate. The dealer price for a diagnosis was high enough to convince him to wait until it got worse, so he decided that he would just live with it for a while. As time passed, he noticed an ad for a local independent Mercedes-Benz shop, so he took it in. They did their magic and life was good until a month later when the light went on again. This then became a series of repeat trips where they would apparently fix it for a while, only to have the intermittent problem reappear. He turned in his repair expenses to his insurance company, and they were watching the claim expenses grow.

Case of the Month: The Moldy Wall

The insured entered an insurance claim based upon discovery of a dark brown moldy growth on an interior wall of the insured’s living room.  The insured was a physician and a toxicologist with specialized forensic training in microorganisms.   GEI was assigned to conduct a limited Indoor Air Quality (IAQ) assessment and to discuss mold related issues with the insured.
